Annual FMCSA requirement
Motor Vehicle Record (MVR) review
At least once every 12 months, a motor carrier must obtain the driver’s MVR from each licensing authority where the driver held a CMV operator’s license or permit during the preceding 12 months. FMCSA does not require a separate annual CDLIS search.
Obtaining the MVR alone does not complete 49 CFR §391.25. The employer must also:
- Review the MVR to determine whether the driver meets minimum safe-driving requirements or is disqualified under §391.15.
- Consider applicable FMCSR/HMR violations, accidents, motor-vehicle-law violations, and serious violations such as speeding, reckless driving, and DUI.
- Keep a copy of the MVR in the Driver Qualification File.
- Keep a note documenting the review, including the reviewer’s name and the date of the review.
