Am I Covered by DOT Drug & Alcohol Testing Regulations?

A quick way to check whether DOT drug and alcohol testing rules apply to your role.

Many employees, owner-operators, and employers are unsure whether they are subject to U.S. Department of Transportation (DOT) drug and alcohol testing requirements (Consortium). These regulations apply only to safety-sensitive positions regulated by federal agencies such as the FMCSA, FAA, FRA, FTA, PHMSA, and USCG - but determining coverage can sometimes be confusing.

The "Am I Covered?" decision tree was created to help drivers and employers quickly determine whether DOT drug and alcohol testing rules apply to their specific situation. By answering a series of simple questions, users can better understand whether their job duties fall under DOT testing requirements or if non-DOT testing programs may be more appropriate.

This decision tree is intended as a general guidance tool only. It does not replace or supersede federal regulations or official DOT guidance. Final determination of coverage should always be based on the applicable federal regulations and the specific job duties being performed.

Consortium FAQ

Quick answers to common questions.

Who needs a DOT consortium?
Many owner-operators and small fleets enroll to meet DOT random testing obligations for safety-sensitive drivers.
How often are drivers selected?
A driver may be selected multiple times or not at all in a year depending on random outcomes.
How do I add drivers?
When enrolling in the consortium, you may add all active drivers who have a negative pre-employment drug test result and have participated in a random testing pool within the past 30 days.

After enrollment, new drivers will be added to the consortium once they have completed a negative pre-employment drug test.
What happens if a driver misses a test?
Missed tests can create serious compliance issues. If selected, the driver must test within the required window.
Do I get documentation for an audit?
Yes — enrollment documentation/certificates and program records are maintained to support compliance.
