FMCSA Drug & Alcohol Clearinghouse: a simple guide for employers & owner-operators

HealthRoute Compliance Team

If you’re a DOT-regulated employer or an owner-operator, the Clearinghouse affects hiring, annual checks, and what happens after a violation. Here’s the plain-English version.

Driver compliance checklist for FMCSA Clearinghouse

The FMCSA Drug & Alcohol Clearinghouse is a federal database that tracks drug and alcohol program violations for CDL drivers in safety-sensitive positions. Employers use it to run required checks during hiring and each year.

Who needs to care about the Clearinghouse?

  • DOT-regulated employers who hire or manage CDL drivers
  • Owner-operators operating under their own authority
  • Third-party administrators (C/TPAs) and service agents supporting employers

If you’re also managing random testing, you’ll typically want a compliant setup through a DOT consortium & random testing program.

What are the two required query types?

Most employers run these two queries:

  1. Pre-employment query: before the driver performs safety-sensitive duties.
  2. Annual (limited) query: once every 12 months for each driver in the pool.
Important: A full query requires the driver’s consent in the Clearinghouse. If you’re hiring and unsure which query you need, call us and we’ll help you pick the correct path.

Top 5 mistakes that cause compliance headaches

  • Not running the annual query for each driver every 12 months.
  • Hiring without completing pre-employment steps (query + testing rules).
  • Outdated contact info so the DER misses important notifications.
  • Mixing DOT and non-DOT paperwork (wrong forms or wrong process).
  • Unclear responsibilities between the employer, DER, and C/TPA.

A quick checklist you can actually use

  • Confirm who is the DER (designated employer representative)
  • Run the correct pre-employment and annual queries
  • Keep your driver roster accurate (adds/removals) so you stay audit-ready
  • Document your random selections and notification process
  • Keep records organized (queries, tests, results, certificates)
